Breaking News: Judge Extends Sam's Restraining Order

In an apparant win for the conservatorship of Britney Spears, a federal judge extended the restraining order late Thursday against Sam Lutfi until March 17. TMZ is reporting the two page order, by U.S. District Judge Phillip Gutierrez, was in response to a request by Britney's father, Jamie Spears, who is co-conservator of her $100 million estate.

Jamie had asked the judge to extend the temporary restraining order--served on Thursday--and set to expire a day later on Friday--until the judge rules on an unusual civil rights challenge to the conservatorship.

The temporary restraining order could be extended at a March 17 hearing, but Jamie Spears would have to be able to successfully serve Lutfi with notice of the hearing.

The judge also ruled that Sam Lutfi was properly served on Thursday (there was confusion over whether the papers were valid because they were served past the original deadline.) Under the temporary restraining order, Sam must stay at least 250 yards away from Britney, her homes, the Spears family and their homes. He is also forbidden any phone contact with the troubled pop star.

According to the order, Lutfi must stay clear of Brit -- and that includes phone contact -- through March 17. What's more, the judge ruled that Lutfi has been properly served with legal papers. Lutfi's rep had challenged today's service of process, but the judge said no problemo.

Keri Hilson was saying because Britney wouldn’t open up about her own personal experiences, it made it tougher to write for her. Did you find that it made it harder for you as well?

It wasn’t hard for me in the creative process with Britney because I was totally left to do pretty much whatever I wanted to. If she felt it, she was gonna ride with it. If she didn’t, you’d see it in her face. I don’t think she needed to open up. She did have one record where she’s mentioning certain things, but it’s in a clever kind of way, not necessarily pouring her heart out. We’ve known Britney for entertaining, dancing and giving you a sexy record, getting you moving. And that’s what we did. Unfortunately, she’s in the state that she’s in, but the music speaks for itself. In the studio she was dancing, laughing in the booth. She gave the right type of energy. That’s all that matters.

Did it disappoint you that the public didn’t respond as well to her VMA performance as they did to the actual “Gimme More” song?

It didn’t bother me until nine months down the line. I was like, "I wish she could’ve really nailed that performance ‘cause that really would have set it off." It was still top five [on the Billboard] Hot 100. I didn’t think the performance was really that big of a deal. She looked a little spaced-out. To me it looked like she was completely nervous. She hadn’t been on stage in I don’t know how long. During the performance, I was watching like, "Just give me that one pop to let me know you back." And it never happened. I was rooting for her regardless.

At the end of “Gimme More,” you were talking on the record. What prompted that?

[Laughs.] I just felt like I needed to say something. People haven’t really seen me or heard my voice, and that was one of my first solo productions. So I definitely had to stake my claim. There's a lot riding on my future, because people think I’m around because of Tim and they don’t really know what I’m capable of. After we mixed that record, I just knew that record was crazy. Period. We got all these hit records and I haven’t got any on my own. Well, here’s one.

Has all the drama overshadowing Britney’s project and Duran Duran's lackluster sales had any affect on you?

It definitely weighed on me. At one particular point last year, I felt like, "Man, I did all this work, and it ain’t pop like it’s supposed to pop." I was down for a little bit. It wasn’t that I wasn’t proud of my work. It’s just things with the business that sometimes happen that affect your music. You could put your all into the music, and it’s some executive decision that ruined it. I don’t count it as a failure. It’s just a lesson learned. In the Britney case, every producer, songwriter or arranger on that record did their thing. The record label did their thing. That was just something uncontrollable on her part. Duran Duran [is] an old group, [and] a lot of people are not familiar with them. Not saying that it’s over for them. It’s just a matter of reintroducing them.

Britney Spears’ new video won’t premiere on TRL Monday

Sam Gets Served-Finally!

Hey Sam! You Got Served!

TMZ has learned Brit's BFF, Sam Lutfi, has finally been served with a restraining order from her parents -- sorta.

As we reported earlier, the restraining order had to be served by yesterday at 1:30 PM to be valid. We're told that since it wasn't served until today, it may not be valid! That means they may have to serve him again with updated paperwork.

We hear Sam was finally found at his house in West L.A., today at around 11:00 AM PT as he walked out the door.

Update: MTV - No New Britney Music Video Monday

Since MTV released a statement saying they are 'going to snitch' a look at Britney's new music video for 'Break The Ice' there have been a lot of rumors about what they mean and here are the most reliable:

Rumor #1 - Britney will shoot the music video on Friday, February 22nd, and MTV will show a couple of seconds of the clip.

Rumor #2 - MTV will not show a clip of the video but they will talk about the script for the music video.

Rumor #3 - The music video will consist of old Britney clips of her in other music videos and performing.

Rumor #4 - MTV lied and there is no clip except of an impersonator immitating Britney.

Now again I want to emphasise that these are rumors and that as of now nothing is confirmed!

Britney's Dad Fights Back to Keep Control

Lawyers for Jamie Spears contend that Britney Spears's conservator case shouldn't be transferred from state to federal court and that an attorney seeking the move doesn't even represent the pop singer as he claims.

In court papers filed Tuesday, Spears's father and the other temporary co-conservator of her estate, Andrew Wallet, called lawyer Jon Eardley's highly publicized efforts to move the case "a brazen – but vain – attempt to strip a probate court of jurisdiction ... by an attorney without a client.

"Eardley's effort got a cool reception from U.S. District Judge Philip Gutierrez, who on Tuesday gave Eardley until Feb. 29 to argue why Gutierrez shouldn't reject the request. If Eardley fails to make a good enough case by then, the matter stays in state Superior Court – with Jamie and Wallet remaining in charge of Britney's affairs and $100 million estate.

"The jurisdictional allegations appear to be defective," said the the judge in a tentative ruling.

Legal Analyst Calls Challenge Novel

Eardley's approach "is certainly novel, but I don't think it can succeed," says Duke law school professor Erwin Chemerinsky, a constitutional law expert. "A case can be removed from state to federal court only if it could have been brought in federal court in the first instance. I can imagine no possible way that this case could have been brought in federal court in the first instance."

Loyola Law School Professor Stan Goldman adds: "Wishing doesn't make it so."

Eardley was unavailable for comment. His spokesperson, Michael Sands, said on Wednesday that Eardley would file "overwhelming evidence" as to why the case belongs in federal court.

"Obviously the judge wants to see what we have expressed in our original papers," Sands says, adding he sees Gutierrez's request for additional documentation as a "great opportunity."

Lawyer Claims Britney's Civil Rights Denied

Eardley has told PEOPLE that Britney – whose affairs have been overseen by the co-conservators since her hospitalization in a psych ward – is being "deprived of her Constitutional rights." He says he's seeking a "return to normalcy" when it comes to the singer's living and legal situations.

But according to the co-conservator papers, a court has already found that Britney "lacks the capacity" to hire an attorney – Eardley or anybody else – and even if she did have that capacity, there are no legal grounds to move her case to federal court.

The papers didn't say whom Jamie thought was behind Eardley's involvement, but noted that Eardley's spokesperson also represents Britney pal Sam Lutfi, now the target of a restraining order by the star's parents.

Eardley, the papers allege, tried to do something similar in 2006 – allegedly seek to move a state case to federal court on behalf of a client he didn't have – and was ordered to pay the other side's attorney fees.

"Given his prior experience, Mr. Eardley should have been especially attuned to the impropriety," the papers say.

Two Australian radio DJs, in Los Angeles for the Oscars, totally tricked the paparazzi into believing they were driving around with Britney Spears covered in a blanket in the backseat of their SUV.

It must be easy peasy!

Kyle and Jacki O rented a Black Escalade and somehow managed to trick the paps into believing it was Britney in the back seat.

Clue #1 - Britney always drives or rides shot gun. She wants to be seen!

The pair then headed to a nearby Burger King and ordered some food while 'Brit Brit' is in the back seat, covered up to avoid the paparazzi flasbulbs.

You'd think for people that make their living following Spears around, they'd realize when a decoy is employed.

Dad Fights "Brazen" Attempt to Move Brit Case
