X17 XCLUSIVE - Will Britney's S.O.S. Be Heard In Court Tomorrow?

An X17 source tells us that Commissioner Scott Gordon has apparently "had it" with the large number of ex-parte hearings called in the Britney case - they're not normal. Tomorrow's 8:30 a.m. hearing (Brit herself is not expected to appear) will consolidate a number of issues.

Also, Britney's lawyers Trope and Trope - who are arguing for Brit even though they're on their way out - will make a motion to revert to the September '07 order, which would give back Britney and ex-husband Kevin Federline 50-50 custody of their two boys. We also hear Trope and Trope will request a gag order.

Britney's been recently talking with her new attorney, Jon Eardley, telling him: "I want my life back.!

Via his spokesman Michael Sands, Eardley tells us that "the conservatorship is radically oppressive and unnecessary."

In the paperwork filed by Eardley last Thursday, the documents point out Brit's "deprivation of civil rights." This includes the following:

- Britney not being allowed "a single hearing before the court"

- Not being able to "access counsel of her choosing and to meet with her counsel in a private meeting"

- Being "denied the right to associate freely with her friends" - which also includes no telephone calls, no driving nor the right "to receive and send mail"

- And lastly, "she has been denied the right to her finances."

That's quite a lot to have taken away, don't ya think?

The Britney Effect: The Impact a Year After Her Buzz Cut

A year after her buzz cut seen around the world, Britney Spears's Feb. 16, 2007, antics continue to affect the two owners whose stores she visited that night.

"It was a major disruption in my life," says Esther Tognozzi, owner of Esther's Salon, where Spears shaved her head. "I have tourists come by from other countries, and we keep the door locked since people try and sneak in to take pictures or sit in the chair she sat in."

Tognozzi no longer answers her salon phone (due to the high volume of media calls as well as pranksters) and was forced to hire a lawyer when people started posting Web sites in her name, pretending to pawn off Spears's hair.

"They were using my identity," Tognozzi says, "Talk about an invasion of privacy. I got a little glimpse of her world, and it makes me feel bad for her."

Having been in business for 25 years, Tognozzi has a loyal clientele, and she prefers to take on new customers on via referrals. Still, she will get the occasional fan.

"This idiot came by the other day, and he makes a buzz gesture and asks to get a haircut," she explains. "He said he had come all the way from Canada."

Awaiting Britney's Return

Still in possession of Spears's hair and the buzzer used that fateful night, Tognozzi says she is only waiting for the pop star to retrieve the items herself.

"People offered me quite a bit to buy it, especially in the first 48 hours since they wanted to drug test it," she says. "But it would be nice if she came back and collected it."

Tognozzi is hoping her discretion will pay off for the Etchmiadzin Children's Fund, an Armenian orphanage she works with. "Maybe she'll give me a check to help the orphanage," she muses.

Trouble at Tattoo Parlor

While Tognozzi has her share of pranksters, Dave Rothburgh, the owner of Body and Soul Tattoo in Sherman Oaks, where Spears went after her haircut for two tattoos (a black, white, and pink cross on her hip and red lips on her wrist), had to deal with a more dangerous audience.

"We had stalkers and people calling with death threats," Rothburgh remembers of the months after Spears's visit, "They would leave nasty messages, like, 'We're gonna kill you! How could you do that!"

Chuckling at the thought of doing "$10 million in Spears tattoos", Rothburgh was taken aback, and relieved, by the lack of interest. "We were surprised that we only had one or two people asking for the Britney Spears lips. But even those people do it as a joke, not because they idolize her."

Now, things are pretty much back to business as usual. He says, "You get all the hoopla for a few months, then nobody really cares." Still, Rothburgh admits, "We did have a BBC crew in last week who wanted to look around."

Britney Goes After Celeb Attorney

Sources close to Britney Spears are telling OK! that the most likely candidate to replace her current lawyers in her ongoing custody battle with ex-husband Kevin Federline is family-law attorney to the stars Stacy Phillips of the law firm Phillips, Lerner, Lauzon & Jamra.

Phillips is no stranger to high-profile cases, having represented Bobby Brown, baseball legend Darryl Strawberry, and the ex-spouses of Axl Rose, Tori Spelling and Jean-Claude Van Damme, among many others in her 24 years of family law practice.

The Ivy League legal eagle — she has degrees from both Dartmouth and Columbia — is one of the most feared divorce and custody attorneys in the country and has recently written the book Divorce: It's All About Control How to Win the Emotional, Psychological and Legal Wars. Ironically, Divorce received a certificate of commendation from the Mayor of Los Angeles, Antonio Villaraigosa, whose soon-to-be-ex-wife Corina is represented by... that's right — Phillips!

Last week, Brit's current attorneys from the firm Trope & Trope filed their second request to the court to be removed from the singer's custody case.

Calls for comment from Phillips and K-Fed's attorney Mark Vincent Kaplan have not yet been returned.

Britney Is NOT Shooting A Music Video!

There are currently some rumours that Britney will shoot the music video for 'Break The Ice' very soon and that the director is confirmed to be Joseph Kahn.

I can exclusively confirm that these rumours are not true and that as of now there has been no decision on who will be the director. The music video is still in pre-production.

Steve-O Challenges K-Fed

Let's just hope Steve-O's album fares slightly better.

Will Britney Regain Control of Her Life?

Something Fishy Going On In Britney's World

Her new lawyers name is Jon Eardley, and his rep happens to be Michael Sands. Sands also reps Sam Lutfi. Coincidence? I think not! According to x17, Britney spoke to Jon on Saturday night saying, "I want my life back; I want to be able to drive my car; I want to be able to live in my house by myself. I want to say who is going to be my security guard. I want to see who I want to see at any time and make it happen."

This same attorney filed paperwork to have Britney’s conservatorship case moved from state to federal court.

This just goes to show you that Sam definitely has some communication with Britney Spears. How much of a coincidence could it be that Britney hired a lawyer who then hired Sam Lutfi’s spokesperson? If they’re trying to be slick, they can try a little harder.

It was the electric razor buzz heard ’round the world. A year ago on Saturday — on February 16, 2007 — just days after a 24-hour stint at Crossroads rehab center, Britney Spears marched into a California hair salon and announced that she wanted to shave her head. We thought that she’d hit an all-time low back then, but it turned out that Britney had a lot further to fall. And here’s how she unraveled over the next 12 months.

After the head-shaving, the newly bald Brit rounded out the evening by getting two new tattoos. Days later she checked into rehab again, this time at the Promises treatment facility — only to leave less than a day later. Then came the bizarre incident on February 21, in which she attacked a photographer’s car with an umbrella.

The following day she was back in rehab, this time for a month, but Britney’s troubles were far from over. The next year would find the singer trotting out an assortment of odd wigs and hair extensions, often wearing short dresses without panties. She gave new meaning to the word "May flowers" last May when photographs surfaced showing her posing topless with little more than flowers covering her nipples. One hot summer day she pulled over on the side of the road, stripped down to her bra and panties and jumped into the ocean in front of a group of photographers.

It seemed as if the fallen pop star never forgave her parents for forcing her into treatment and refused to let them see their grandsons. In June, she even went so far as to serve her mother, Lynne, with a letter instructing her to stay away from her grandchildren.

Fans hoped for a comeback last fall with the release of her album Blackout and the announcement that she would be opening the MTV Video Music Awards. But Britney’s performance fell flat when the starlet showed up onstage looking dazed and lipsynched and stumbled her way through the song "Gimme More."

Her odd behavior culminated with her losing custody of her children to ex-husband Kevin Federline in the beginning of October. Even Britney’s neighbors turned against her. While out with her sister Jamie Lynn in October, a woman came up to Britney and made it clear that her presence wasn’t wanted. "Nobody wants you in this neighborhood Britney!" she shouted. "You are making this neighborhood very unsafe!"

Jamie Lynn lunged at the woman and screamed in her face, "Then move the f*** out of it!"

Later that month, Britney got her lips plumped and then ran over a photographer’s foot on the way out of the doctor’s office (and didn’t bother to check and see if he was OK).

Along the way there was a string of random men in the singer's life. She had her heart broken early in the year when her ex-boyfriend of six weeks, model Isaac Cohen, sold details of their sex life to a tabloid.

She hooked up with Mindfreak illusionist Criss Angel. She also had a brief dalliance with bodyguard Daimon Shippen, who had caught her older son, Sean Preston, the year before when Britney stumbled on the street and nearly dropped him.

She took on a man named Sam Lutfi as her manager and he quickly became her confidant, rarely leaving her side. She began dating married photographer Adnan Ghalib and brought Chad Hardcastle and paparazzo Filipe Teixeira into her entourage.

The new year brought even more drama. Britney started off 2008 with a three-hour custody standoff at her home. Eventually police had to be called — she was taken to the hospital via ambulance and spent a few days in the psych ward. After her release, she fled to Mexico with Adnan. But by January 31 she was back in the hospital for a week, undergoing mental evaluation. Over the past few weeks, her father, Jamie, has been granted conservatorship over her estate, prompting a turf war with Sam.

The next year is sure to bring more custody battles and theatrics in the life of Britney Spears, but there is some light at the end of the tunnel: She has nowhere to go but up.

The Toxic singer - who was recently admitted to Los Angeles’s UCLA Medical Center for psychological evaluation - has contacted a new lawyer because she is tired of being told what to do.

Britney - whose father Jamie is co-conservator of her estate and all her legal decisions - reportedly told lawyer Jon Eardley: “I want my life back. I want to be able to drive my car. I want to be able to live in my house bymyself. I want to say who is going to be my security guard. I want to see who I want to see at any time and make it happen.”

The 26-year-old pop idol is said to be considering hiring Eardley for her custody case with ex-husband Kevin Federline over their two sons - Sean Preston, two, and 17-month-old Jayden James.

Kevin, 29, currently has full custody due to Britney’s erratic behavior, which has resulted in her losing all visitation rights to the boys.

Meanwhile, Britney spent most of the weekend with her father and her assistant Brett inside her Beverly Hills home.

However they did venture out to Hollywood restaurant Social Hollywood on Saturday night.

An onlooker said: “She seemed totally normal and level-headed, and everyone with her seemed calm. She was with a table of five people.”

Downlow Doings with Brit and Alli

E! News has learned that Britney Spears met secretly with her pal Alli Sims Friday afternoon at the Fred Segal boutique in West Hollywood.

Sources tell E! that Sims arrived at the store about 10 minutes before Britney who then tried to slip inside unnoticed. A source tells E! that Spears hatched the meet-up via text-message, reportedly instructing Sims to meet her in a dressing room there.

The stealth tactics were apparently prompted by the fact that Alli has been prohibited from seeing Britney by her father Jamie Spears due to Alli's loyalty to Britney's former manager and confidante Sam Lutfi. After their cloakroom confab, the pair shopped together briefly.

Later, confronted by an E! video crew outside Italian restaurant Orso on Saturday night, Sims confirmed the Fred Segal meeting with Spears. Sims told E! camera man James Sullivan that she and Britney "had fun" shopping, but Sims wouldn't comment when asked about how Sam is doing.

Well, we know what Sam wasn't doing. Around the same time Sims confirmed her meeting with Britney to E!, Spears was at L.A. nightclub Social with an unusual party partner: her father Jamie.

And, needless to say, no Sam in sight.

Around 6:00 pm PT Saturday evening, the two spoke about the job Eardley would do for Britney -- he asked what "latitude" she would give him in defending her.

Britney responded:

I want my life back; I want to be able to drive my car; I want to be able to live in my house by myself. I want to say who is going to be my security guard. I want to see who I want to see at any time and make it happen.

Eardley filed a complaint in the US District Court on Thursday, on Spears' behalf. He called Jamie Spears' conservatorship a "violation of civil rights."

While Britney's father seems to have put some order back into Brit's life -- hiring bodyguards and an assistant, not letting his daughter out late at night, and restricting her visitors -- Britney seems to interpret all of this as being too restrictive and repressive. Does Britney know best what's best for her?

UCLA Medical Center DID let Britney go, saying she wasn't a danger to herself or others -- after that, how long to do allow someone to control an adult who may have mental health issues but who isn't hurting anyone?

Britney Wants to Hit Mute Button on Custody Case

With Monday being a holiday, the courts of L.A. will be quiet — at least as far as Britney Spears is concerned. But it's only a one-day reprieve, as lawyers for both sides of the pop star's ongoing custody battle with ex-husband Kevin Federline will be back in action on Tuesday, where among several other items they'll argue over a motion by Brit's team to place a gag order on everyone involved in the case.

The gag order request, which was actually made late in 2007, but is only now coming up on Commissioner Gordon's agenda, wouldn't just zip the lips of the lawyers involved — meaning no more post-hearing press conferences — but also of the court's Press Information Officer.

OK! spoke to K-Fed's lawyer, Mark Vincent Kaplan, who admitted there is a chance that the gag order could be put into place, but cautions that, "a gag order isn't going to effect the paparazzi from following Britney or talking to her."

Kaplan also adds that he feels such an order would be impossible to enforce. "I think the protections already in place will do the trick," he explains to OK!. "A large portion of the court documents are already sealed and the court has often granted the motion to close the courtroom."
