"We're not going to jump to conclusions right now," attorney Mark Vincent Kaplan tells E!. "I don't anticipate there being a hearing. I anticipate that Kevin and Britney as concerned parents will exchange information and satisfy themselves that what happened was a freak occurrence and do what they have to do to make sure that it doesn't happen again."
Jayden, 2, was hospitalized overnight on Sunday in McComb, Miss., after suffering a "terrible allergic reaction" to something he ingested, a source close to the Spears family tells PEOPLE.
Spears had taken her sons Preston, 3, and Jayden for a family visit to her hometown of Kentwood, La. It was the first time she was allowed to take them out of state since losing all custody earlier this year.
"Kevin was considering going to Louisiana (after the hospitalization)," says Kaplan, "but the information that we had was Jayden was already checked out. There wasn't an emergency."

Oh come on they are totally making a bigger deal out of then is needed. Fist off it is not kevin decision what happened and second of all her was not even bothered to go to be with jayden. (3) it could of happened to anyone so there would be no need for a court date about this. kevin is just trying to play the ice card by saying he is not going to do anything abbot this. Even if he did want to do something about it the judge would not let him it is just stupid.
