Britney's Case Isn't Going Anywhere Yet

In the wake of papers being filed at the L.A. Superior Court yesterday in which lawyer Jon Eardley asked that Britney Spears' conservatorship and custody cases be moved to the Federal courts, the Superior Court's Public Information Office has released a statement that reads, "It is our view that all current orders in this matter remain in full force and effect."

Michael Sands, a publicist who has most recently been linked to Britney's former pal and manager, Sam Lutfi, told PageSix.com today that the papers filed yesterday would negate both the conservatorship (in which Britney's father, Jamie, was given control over her finances and medical care), and the 21-day restraining order against Lutfi.

But Public Inormation Office says that's not the case, telling PageSix.com, "This has no bearing on either the pending probate case or custody case that we are aware of."

Sands maintains that Eardley has been hired as Britney's lawyer, but the commissioner in the conservatorship case ruled earlier this month that the 26-year-old was not mentally capable of retaining counsel.

Britney's Cases Staying Put, Court Rep Tells OK!

Despite rumors that Britney Spears' custody and conservatorship hearings may have already been moved to the jurisdiction of a federal court, a spokesperson for the office of public information for the L.A. Superior Court tells OK! that this is not true.

"The state and federal issues would have to be litigated among all interested parties involved in Ms. Spears' conservatorship," explains the spokesperson. "And at this time there is no change to any of her hearing dates on the calendar in state court. It is our view that all current matters remain in full force and effect."

At yesterday's hearing on the state of Britney's conservatorship, a lawyer named John Eardley attempted to file a motion requesting that all of the singer's current legal matters be moved to a federal court. As of yesterday evening, the Commissioner Reva Goetz had neither read nor ruled on the motion.

State Court May Have Lost Britney Jurisdiction

It's the craziest thing we've ever heard, but it's probable the State court has lost jurisdiction in the Britney Spears conservatorship case.

Sources at the L.A. County Superior Court tell TMZ, "It's possible jurisdiction has shifted to the U.S. Federal District Court." How, you ask? Well yesterday, a lawyer filed legal papers in federal court asking a judge to seize control of the conservatorship case on grounds Britney was at great risk in the L.A. County Court system.

The sources say just by filing the paperwork, the federal court probably has obtained jurisdiction. We know that sounds bizarre, but legal experts tell us that is indeed what has happened.

A well-placed source in the L.A. County Court system says even if the federal court has jurisdiction, they believe the conservatorship and all orders are still in effect, but no further orders can be made or modified unless and until a federal judge kicks it back to the state.

Bryan Spears: Britney's New Money Man

Britney Spears's $100 million fortune is now out of her hands – and under the control of her brother and a lawyer, a court ruled Thursday. And for 30-year-old Bryan Spears, that means a big new role – keeping tabs on everything from cash to pay for medicine to money for her daily expenses.

Bryan was named a co-trustee to his famous sister's SJB revocable trust, where the singer keeps most of her money, according to court documents.

So what does it mean to be a trustee? Bryan – along with Ivan Taback, a partner in the personal planning department of the New York-based law firm Proskauer Rose who was also named a co-trustee – now have the power to pay for Britney's "continued security, medicine, food, other day-to-day expenses and for psychiatric and other medical services," according to court documents.

Bryan and Taback were named co-trustees because of an existing clause in the trust. According to the trust, if Britney stops being a trustee, "then Bryan Spears ... and Ivan Taback may act as successor co-trustees under the trust "

The troubled 26-year-old singer, who was recently released from the UCLA Medical Center psych ward, has been stripped of her trustee powers because she is currently considered "legally disabled" by the court, which also extended her father Jamie's co-conservator role until March 10.

The motion to make Bryan and Taback co-trustees was filed by Taback's law firm. However, according to the motion, neither party can act unilaterally, but require "unanimous consent" with the other trustees to act. The documents also state that the trustees can't sell or lease Britney's home without a court order, nor can they remove any of Britney's property from California.

The trustee appointments were made a week after conservatorship attorneys were granted the right to fire Britney's business manager, Howard Grossman.

Danielle Steel Talks About Britney's Situation

In a rare interview, New York Times best-selling author DANIELLE STEEL comments on BRITNEY SPEARS' situation telling Reuters, "I feel so sorry for her."

Steel speaks from experience. Her son NICK was diagnosed at the age of 16 with bipolar disorder and committed suicide more than a decade ago at the age of 19.

"Usually bipolars present extremely well and they can bounce into court ... look very together and be a complete mess three hours later on the streets somewhere," she told Reuters at an event for the 10th anniversary of the creation of the Nick Traina Foundation. "There's nothing you can do."

In echoing the recent and widespread speculation regarding Britney, Steel suggests that her problems, "illustrate the drama and dilemma of the family of mentally ill people in this country -- it's a very, very tough thing."

But she says there is hope for the troubled pop star and her family. "If it is the case (that she has bipolar), she can get on track with the right treatment and medication," she says. "In the case of Britney Spears' parents what you have to be is extremely loving, extremely resourceful and extremely persistent and every time you're defeated, just go at the problem again."

Lawyer: Britney Being Held in "Private Prison"

In a new motion dropped off at the courthouse today, New York lawyer Jon Eardley claims that Britney Spears is being "subjected by her parents to their complete and total control."

He goes on to allege in the documents that while Brit's "prescribed medications are designed for out-patient use...she is being confined by the conservator to the private prison of her own home."


Eardley asks that both Britney's custody and conservatorship cases be moved to federal courts, because "it is doubtful that Ms. Spears can receive equal protection and a fair trial or hearing...because of the intense media scrutiny." He states that only in a United States District Court could Britney (who is called in the docs, "the most public person who has ever lived.") have her "civil liberties" adequately protected.

Britney's Brother to Manage Her Assets

Britney Spears' brother, Bryan, has been named trustee to Britney's trust.

In court documents obtained by PageSix.com, Bryan and lawyer Ivan Taback are granted temporary co-trustee powers to the SJP Revocable Trust, a trust "established by Britney to hold substantially all of her assets."

The trust had been entirely in Brit's name, however, according to the court files, other people can be added to the if the acting trustee "is under a legal disability or if by reason of illness or mental or physical disability, in the written opinion of two doctors then practicing medicine, he or she is unable to manage his or her affairs."

In stranger news, Sam Lutfi's spokesperson Michael Sands dropped off documents at the courthouse today requesting that both Brit's custody and conservatorship cases be moved to the federal courts where the pop mom's "civil liberties" can be better protected.

When PageSix.com asked public information officer Allan Parachini about the request, he expressed that it was unprecendented.

Sam's Bizarre Legal Maneuver?

In a bizarre move on Thursday, publicist Michael Sands, who used to be the mouthpiece for Kevin Federline's attorney Mark Vincent Kaplan, but who now represents Britney Spears' strange little friend Sam Lutfi, attempted to file a motion with the court to have both the pop star's custody and conservatorship hearings moved to the jurisdiction of a federal court.

The papers, delivered by Sands but not yet reviewed by the judge, were drafted by lawyer John Eardley, who has offices in Jericho, NY, and Washington, DC.

According to the document, Eardley argues that the federal courts should take both cases and claims, among other things, that Britney has been "stripped of her right to access counsel of her choosing... denied access to her motor vehicles... denied the right to associate freely with her friends," and perhaps most telling, "denied the right to her finances.

"One case insider tells OK! that Sam is obviously behind this latest move. "He's upset because he can't see Britney and have her pay him money," explains the insider. "If Sam gets paid, then he can pay the lawyer and Sands. It's all ludicrous."

As for whether there is any merit to this motion, the insider tells OK!, "I'd be willing to bet that aside from Sam and Sands grandstanding on the courthouse steps, this is the last we hear about it."

Lynne Spears Gets Out of Dodge
