Custody Trial? What Custody Trial?

Britney Spears and Kevin Federline don't want to fight over their kids in court. Family insiders exclusively tell PageSix.com that there will not be a custody trial showdown between the pop star and her ex-husband — thanks in part to the presence of Brit's dad, Jamie Spears.

"Britney's progress since Jamie has become her conservator has made a lasting impression on Kevin, and he realizes that she is dealing with a lot and being proactive in her treatment," says our source. Kevin doesn't want to add to her angst with a long, protracted custody battle. His main priority is the safety and well-being of his sons, Sean Preston, 2, and Jayden James, 1.

Jamie "has made strong headway convincing Britney how close she could come to losing the kids if she doesn't do something to change her behavior." The 25-year-old star, who has had several visits with her sons and "just lights up the minute she sees them," realizes that she controls her destiny with the boys, according to our source, and that "any return to her past antics would force Kevin to pursue a custody trial."

Could a custody trial be averted? Yes, say family law experts, when both parents are able to agree to the terms of a formal custody agreement. We are told that Brit's family law attorneys are working toward "an ironclad custody agreement that would keep this drama from playing out in the public."

Mark Kaplan, Kevin Federline's attorney, recently told OK! magazine that the custody trial that was supposed to begin in April would most likely be delayed because Britney has a new team of attorneys. Kaplan has also said that Kevin has never wanted to keep the boys from their mother.
